The district is reviewing a draft revision to Policy 815, ‘Acceptable Use of Internet, Computers and Network Resources.’ The proposed text prohibits users from accessing or transmitting ‘hate speech’ and ‘offensive or inflammatory communication,’ creating exposure for unconstitutional viewpoint discrimination and chilling protected speech.

PRE-VOTE ACTION: Item 2.B proposes draft Policy 815. Send a pre-adoption legal notice to the Board identifying the First Amendment defects in the prohibitions on ‘hate speech’ and ‘offensive or inflammatory communication’ before the policy advances from committee.
